Nvidia confirms it is under scrutiny in EU, US and China

Nvidia has confirmed that it was raided by the French competition authority in September and stated that it is under investigation by regulators in the European Union, the US and China.

The dawn raid by the French antitrust regulator, the Autorité de la concurrence, was related to suspected anticompetitive practices in the graphics cards sector (see Nvidia comes under European anti-competitive scrutiny).

The regulator did not name Nvidia at the time, but the company has revealed itself in the regulatory filing for its third quarter for fiscal 2024 (see Nvidia triples Q3 sales, confirms chip leadership). The company also said it is facing increased interest from other regulators.

In the 10-Q filing with the Securities and Exchange Commission the company stated: “Our position in markets relating to AI has led to increased interest in our business from regulators worldwide, including the European Union, the United States, and China. For example, the French Competition Authority collected information from us regarding our business and competition in the graphics card and cloud service provider market as part of an ongoing inquiry into competition in those markets. We have also received requests for information from regulators in the European Union and China regarding our sales of GPUs and our efforts to allocate supply, and we expect to receive additional requests for information in the future.”

The company did not provide further details of the investigations but commented that growing awareness of the strategic importance of artificial intelligence technologies may result in additional restrictions on its ability to provide products and services.
